Get Overdraft Fees Back from Bank of America by Writing to Their CEO

October 18th, 2008 David Leave a comment Go to comments

Bank of America used to be the largest bank by assets and second largest commercial bank by deposits before the acquisition of WaMu by JP Morgan chase & Co. Bank of America’s most popular banking products may be the MyAccess Checking Account and the Keep the Change program. However, there are a lot of complaints about the terrible overdraft fees. Here I will tell you the most useful method to get the overdraft fees back from Bank of America.

Why the overdraft fees are so terrible?

First, what’s “an overdraft fee”? An overdraft item fee occurs whenever funds must be provided to cover a transaction that overdraws the account. Believe it or not, overdraft fees have increasingly become a source of profits. Banks and credit unions collect about $17.5 billion in overdraft fees per year. As reported by USA Today:

In 2007, Wachovia put in place a tool that tells employees how much they can refund to customers hit by overdraft fees. The bank, in memos, also tells employees to “sell” a debit card with every account because it makes money when consumers use it.

Bank of America raised the fee charged on the first day a customer overdraws to $25 from $20. BOA also raised the number of times a customer can be hit with this fee per day to seven from five. It’s really terrible. Furthermore, the next following days after the first day, the fee is $35.00 for each item. A customer can easily get up to $500 fees just for the overdraft. And it’s vry common to pay $100 over draft fees for just 2 or 3 cups of coffee!

It’s common to go to your local BOA branches to complain the over draft fees if it really happens to you. Or you may call BOA up to appeal. However, most of the employees are trained to give you a samll portion or even nothing to you. So there must be other ways to get the money back.

After a little search on the web, I realized that the most effective way to get the over draft fees back is to write to their CEO!

This has been confirmed to be successful for many victims of BOA’s over draft fees. The CEO of Bank of America’s address is:

Mr. Kenneth D. Lewis
100 N. Tryon Street.
Mail Code NC-1-007-18-01
Charlotte, NC 28255

In the letter to the CEO, all you have to do is to state the reason why you have so many over draft fees and tell him that as a loyal BOA’s customer, you hope he can help you!

And there are other methods to reach BOA’s executive customer relations.

Thanks for posting this information! Silly me, until I read your address for Mr. Lewis, I had completely forgotten that I live in the same city as the Bank of America headquarters, here in Charlotte! I wonder if I can go down there and request an appointment with someone in corporate to refund my unfair and unreasonable overdraft fees? Well, in the very least I plan on writing a letter. I will post later how it goes!

worked for me, too… $210 for 15 minutes lecture. it’s really just sugar sprinkles on the heap of crap that b of a is… but still – thanks david. you rock!

thank you for the information! the tel# you provided saved me $315 after being told by various representatives and supervisors that the fees had been “decisioned” and there was nothing that could be done. in defense of b of a, overdraft fees aside, the bank has been very helpful in rebuilding my credit and their online banking is the best in the industry.

Bank of America has currently charged me $350 (10 x $35) and have 5 more transactions= =$175 on the way to be charged all because of a Personal Bankers statements. I am going tommorow to my local branch as it was them who had told me that a payment did not go through (which caused a double payment) and subsequently the overdraft charges as it was a large payment!

The (704) number was very helpful! I had 3 misc. fees on my checking and savings. (Not Overdraft). They removed all 3 charges and were pleasant about the whole thing. WHen I spoke to the regular customer service banking number, they hung up on me. SO this was a nice surprise. Thanks for the info!!

Thank you sooooooooooooooo much for this information it really helped me.
I’ve had my account over 20 yrs and really made an honest mistake this was my first time ever over spending on my account. The representive was very pleasant and courteous I did admit it was my fault. Bottom line she reversed almost 100.00 in my acct. I checked 10 mins later it was already back in my acct.

    Thanks for this information

Great info but we need all dump BoA! Find a small local, or regional bank that didn’t take TARP and that didn’t play in the subprime mortgage market and doesn’t need to make up it’s losses on the backs of its customers in excessive fees. I was about $100 over drawn, but they stacked my charges over the period of 4 days from highest to lowest so all the small 10 or 20 dollar charges were hit with at $35 OD fee, to the tune of $575 in OD fees. If they had been charged to my account in the order they should have been i would have had 2 OD fees, not 11. The are also holding deposits until the next business day, even those made at the teller, when i asked the customer service operator if they would hold a cash deposit for that long, she hung up. I”m going to BoA today and try to get the fees returned then i’m closing all my business and personal accounts. I urge everyone to do the same!

To all the people who are thinking if this would work,
Call the 704 number, I called today at 6pm EST (not sure if that makes any difference), a very nice lady answered the call. I told her that I made one honest mistake but with the way their software worked(or any other bank’s software?) resulted in 6 overdraft fees. I already got refund for 2 from regular customer service (800 number), she looked at my history and also looked that I have other accounts with them and refunded the remaining 4 overdraft fees immediately.

This is the first time a website helped me getting back my money.

Cannot thank enough the original poster.

I was skeptical, but the 704 number really works! I can’t remember the name of the lady that I spoke with, but she was really nice. She had no problem refunding the fees and all she wanted to know was how I got the number. She didn’t make me listen to whole speech about I should be more careful with $ like some others have mentioned. So thankful for this post!! Call now…if it doesn’t work the first time around it doesn’t hurt to try again later.

10/21/09; This really works!!! OMG Thank you so much. I received $70 in fees for an honest mistake. The 1-800 was not willing to refund me, and stated that the “descision” had been made. I am not one to take a “No” for an answer, as nothing is ever set in stone. So I researched “Bank refunds BofA”, and found this wonderful post. I immediately contacted the Executive Branch, and spoke to the most pleasant woman. She listened, offered advice and tips to ensure this doesn’t happen again, and then proceeded to refund my $70 (Yahoo, my new pair of Boots!!!!)… LOL. No, thanks so much for posting and sharing this contact info., whoever you are, you made my day :)

Another witness that the 704 works. Don’t be rude or demanding. Be humble, listen to the lecture about being more proactive with your spending habits, and it’ll pay off. The lady is patient and helpful and will give you advice and tips on how to avoid further overdrafts. Within 10 mins, my account was refunded $280.

UNREAL, IT REALLY WORKS! THANK YOU SOOOO MUCH for posting!I just came across your posting a few minutes ago and decided to give the 704# a shot (I have tried everything else to get my money back). I can’t believe somebody picked up right away and (in a pleasant, non accusatory manner) resolved my issue in less than 5 minutes. The gentleman that answered the phone didn’t even ask for my reasons, nothing, just pulled up my account and gave me my much needed money back. Long story short, I was expecting a deposit on Monday and it arrived on Weds. In the mean time, I saw that my account had pending charges. So that I would not incur the overdraft fees, I went and searched for the closest BOA in my city (i had just moved). To my surprise, there wasn’t a BOA (or atm’s accepting cash) for well over 100 miles and I couldn’t deposit my cash! So, while the charges were still pending, I called and the agent said there was nothing he could do. Once the overdraft fees cleared my account (35 X9= $315), I called again and asked could they refund fees since I (truly unknowingly) had no access to a branch. Two customer service agents and a supervisor later they still refused to refund any of the charges. I have been so angry about these charges but wasn’t getting anywhere (happened early sept) with the 1-800. Anyway, I just stumbled on this posting and called the 704# right away. And just like that, I got all 9 ($315) overdrafts refunded in an instant. THANK YOU SOOOO MUCH (again)! What a truly pleasant surprise!

Thank you so much for posting this! My boyfriend gave me this number yesterday, but I was a little skeptical about calling. Bank of America’s customer service is not the greatest. I called the 1-800 number and they would only refund 1/3 charges. I called this number and spoke to a lady named Denise. She was very nice and even though she lectured me for about 10 minutes, she refunded the other 2 charges!!!!! I got all $105 in overdraft fees back! Thanks again!

@ 12:15 am central time 11/04/2009 I found this website after a simple search on goggle
I had been getting a lot of over draft fees in the last year this morning this morning my account was negative -$574.00 they was able to assist me to where I now have a positive balance of $274.00 do the math I would like to thank who ever made this info available will note that the rep that assisted me was not simply excusing me of my irresponsible swiping behavior. She spoke in a concerning yet stern way to insure that I do a better job keeping up with my purchases using a registry every single time I swipe. I will I have to do this and I hope all will as well we must, as times are hard enough as it is God Bless!

I cannot thank you enough for publishing this information!!! You made my day today! I called the 704 # today and was able to get all 6 charges = $210 refunded. The lady that answered “Yolanda” was kind and polite and did lecture me and at first she made it appear as if it was just my fault and that BofA had NO responsibilities to stop accepting charges AND I thought for sure she will not refund the $….but she eventually did. She said she would review my acct. after I made my plea that I have not done this before and that I’ve been with them for quite some time now. She also asked me if I wanted to opt out of the overdraft protection…I said of course. I did agree that I do have a responsibility to keep track of my acct. and I am at fault too. I am SHOCKED that she returned all the money! I am thrilled! Please, please everyone pass this along. OBTW…I did not mention this site directly but told her I got the number online when she inquired. MANY, MANY THANKS – GOD BLESS YOU!

Thank you – what a public service you have provided. I got $910.00 refunded by writing to the executive office and all the other addresses listed. The charges were too far in the past for the person on the phone to address, but the Executive Office actually called back and said they’d taken care of it. I have to give BofA credit for responding promptly and so positively. And most of all, thank you again for posting this information. This means a LOT to our family.

thank you sooo much for this post!!! Let me start off by saying that I was very skeptical about getting my situation worked out. I dont have the patience or the desire to argue with people over the phone about money. I was getting ready to pay my overdraft fees and close my account when I decided to google my matter. The woman I spoke to was very professional and polite. I admitted that it was my mistake but that it was my first time getting an OD fee in 3 years of banking with them. Just be honest with them and do not get rude or nasty with them. After a 25 minute convo which included really helpful money tracking tips, I was given a credit and had my 3 OD fees removed! It does work!

I just got off the phone with a very nice lady and explained to her that a simple mistake ended up in $210 worth of overdraft fees and she didn’t lecture me about it or anything. She was very understanding and reviewed my account and she could tell where the tiny mistake was made on my part. 10 minutes later…$210 refund in my account just like that!! :)

Call, be nice and more than likely you will get a refund. :)

    Thanks for the #, BTW!!!

THANK YOU FOR POSTING THIS… I can now fully pay off a pending insurance bill that I was going to have to finance!

I was skeptical, but I called the 704 area code number and explained my situation to the gentleman I spoke to. I received 13 overdraft fees in three weeks due partially to a bank error and partially to my own math error. He was very pleasant and friendly. I did not get any money handling tips, but I was told that the fee refund I received (not all the fees, but a nice portion thereof) was a one-time courtesy and to be more careful in the future.

Thank you for the information! Had 8 overdrafts, and customer service lead me nowhere. Now, I know I made a mistake but 35$ * 6 is unbelievable. I checked my online account, and even transferred fees to my account to cover the shortage, and even the ATM showed a good balance.

That being said, I’m satisfied with this number. I was seriously thinking of switching to banks that PROACTIVELY protect against overdraft fees, but I’ll stay with BOA, as I guess the sad economy has BOA less willing to forgive.

    **********BE AWARE********
The first level customer service folks are cold but ok, they’re just doing what they were told, BUT

I asked to speak to a manger, and that when I got pissed.

    a) “You overdrafted 11 times before, this is not the first, thats why we cant……..”

NO you’re BSing and you know it. 8 of those were this weekend, which is why I’m calling, and 3 of them were PENDING, never OVERDRAFTED, and I transferred funds and blocked them successfully. Just like how everything on your online banking site is PENDING, and doesn’t accurately reflect your account, and PENDING isn’t the same as an actual overdraft, its PENDING.

You’re a manager, you know the difference between pending and overdrafting. Don’t lie to me.

    b) “We already talked about this. We can’t do anything, not the branch manager, not any other bank official, you can keep calling, but noone can do anything, we all use the same system”

B.S. Like, you tattoo my fees onto someones back so you can’t erase it? Like the number is carved from stone and you store it on Easter Island, and if we wan’t to change it you’re gonna have to carve another statue? Guess what, I called executive customer service, and they took care of it. Don’t say it, don’t lie.

    c) “Tell me the name of the bank branch that gave you this customer service number and I’m gonna tell them that they are wrong, tell me the name of the associate”

WHAT???? That associate didn’t say anything wrong, just to call this number, and they MIGHT do something, and you want his number?

Alright, I’m gonna give you his name. Then, I’m gonna ask for YOUR name, and include it in the letter that I’m gonna write to customer complaints.

If you’re gonna say no, just say no, don’t come up with excuses.

OMG! I can’t believe this worked! I had made a mistake paying a bill out of the wrong acccount which left me with $245 in OD fees. I called the reg. number, got elevated to a manager, and was credited with $80. After an arguement with my husband saying that I couldn’t do any more, he found this site and asked me to try it. I called the 704 number, they credited me the additional $165 and through in 2 months of account fees for my trouble! Dang! Now I have to tell him that he was right!

I called the 704 and a nice rep answered the phone she told me if i was calling for complaint or fee on account. I then advised for fee on account. Next she ask me how i got the number n I advised her online ( not from this site though). I then proceeded to tell her i got over drafted 7 times but i did have money on account, She told me this happen cause of charges on weekend. she then gave a lecture how to use mobile banking and credited 5 out of the 7 charges. I happy but i will keep a closer eye on my usage to avoid this in the futture.

OMG, thank you very much, I had a check that someone took long cashing and i forgot about that being said i had3 overdraft fees for small tranactions as small as $3 at grocery store and $5 at burger king. I kept putting money in and kept going overdraft because of the other overdraft fees. I had a total of 9 overdraft fees! I’m unemployed and it was the worse thing to happen. An associate had given me back 2 and the lady i spoke to on this number gave me back $210!! Omg thank you. I was skeptical to call i figured noone is going to do more, but i took the chance and thank you!!

Yesterday brought my account up to zero but I was still charged an over draft fee, I was miss informed by one of their customer representatives on when my negative balance had to be paid. I called the regular customer service number and they refused to refund me the overdraft charges. I asked to be transfered to a supervisor and she refused to drop the over draft fee and she said there was no one else I could talk to about it. I asked her what she did and she said she was the supervisor for the BofA customer service. I was mad because I knew she was lying to me. She said there was nothing she could do to drop the fee.

thanks so much for this info, I called the number you gave and they dropped the charges.
I am a student and I cant afford to pay them anymore money.

so amazing just got refunded. thank the lord.

i was slammed with 1000 dollars worth of overage fees just this year to date, thank god the women who helped me on the phone was so understanding and generous and help me out so much.

be polite, these workers are B of A users and are trying to make sense and trying to help out the clients with the system as well.

But again. overage fees are ridiculous.

Thank you for the 704 #. I talked to a very nice lady Denise at the CEO office. If you have a good history with B of A, they will refund you the overdraft fees. They refunded me $350. Denise gave me a long speech about keeping a check register. If you get a speech, just say ‘yes i made a mistake but i ask as a longtime customer to refund this one time’ and I am sure they will

    worked like a charm

The woman I spoke to asked me how I got the number, and then lectured me on the importance of balancing my account.

After that, she credited my 4 overdraft fees. Good thing too, because I was going to cancel my entire account with them if they hadn’t.
