Get Overdraft Fees Back from Bank of America by Writing to Their CEO

October 18th, 2008 David Leave a comment Go to comments

Bank of America used to be the largest bank by assets and second largest commercial bank by deposits before the acquisition of WaMu by JP Morgan chase & Co. Bank of America’s most popular banking products may be the MyAccess Checking Account and the Keep the Change program. However, there are a lot of complaints about the terrible overdraft fees. Here I will tell you the most useful method to get the overdraft fees back from Bank of America.

Why the overdraft fees are so terrible?

First, what’s “an overdraft fee”? An overdraft item fee occurs whenever funds must be provided to cover a transaction that overdraws the account. Believe it or not, overdraft fees have increasingly become a source of profits. Banks and credit unions collect about $17.5 billion in overdraft fees per year. As reported by USA Today:

In 2007, Wachovia put in place a tool that tells employees how much they can refund to customers hit by overdraft fees. The bank, in memos, also tells employees to “sell” a debit card with every account because it makes money when consumers use it.

Bank of America raised the fee charged on the first day a customer overdraws to $25 from $20. BOA also raised the number of times a customer can be hit with this fee per day to seven from five. It’s really terrible. Furthermore, the next following days after the first day, the fee is $35.00 for each item. A customer can easily get up to $500 fees just for the overdraft. And it’s vry common to pay $100 over draft fees for just 2 or 3 cups of coffee!

It’s common to go to your local BOA branches to complain the over draft fees if it really happens to you. Or you may call BOA up to appeal. However, most of the employees are trained to give you a samll portion or even nothing to you. So there must be other ways to get the money back.

After a little search on the web, I realized that the most effective way to get the over draft fees back is to write to their CEO!

This has been confirmed to be successful for many victims of BOA’s over draft fees. The CEO of Bank of America’s address is:

Mr. Kenneth D. Lewis
100 N. Tryon Street.
Mail Code NC-1-007-18-01
Charlotte, NC 28255

In the letter to the CEO, all you have to do is to state the reason why you have so many over draft fees and tell him that as a loyal BOA’s customer, you hope he can help you!

And there are other methods to reach BOA’s executive customer relations.

I called the 704 number and I spoke to Jose. Prior to calling this number, I had called customer service and they were only allowed to refund me one OD. Jose was very nice and understanding and was able to give me back 4/5 of my OD’s. Thank you so much for posting this!

Just another note to let everyone know that this number works. I was very hesitant to call, but in the end, I got back 4 out of 7 overdraft fees. Not sure why I didn’t get them all back like others, but hey, I’ll take it. Lady was very nice – just had to listen to their lecture about how to do better banking!

Please don’t hesitate to call – this really works.

    Thanks for posting the info!!!

I was so worried to call this line because I thought my problem though major to me, would be to small for the executive office to even give one breath. I stammered a little in explaining my circumstance, that I had not realized my account balance was so low, and that I use my debit card for every purchase. So even though I only spent a cumulative 150$ in the negative I was slammed with $490 in over-draft fees. She looked over my account and found that I had never overdrawn in the past, and that I immediately deposited and transfered money into my account when I saw it was negative. She said that she could tell it was a one time mistake, and that everyone deserves a break, and deserves room to be “flaky” (the word I used to describe my behavior) once in a while. She actually refunded all $490 in fees!!!!!!!!!

  5. Im SOOO Happy I Found This Website

I just wanted to say I mailed a letter to the CEO of B of A. I wasn’t expecting to hear back, especially since i new it was our fault for the overdraft, but today we recieved a call from the CEO himself. He actually was kind and friendly and told us we would have a refund within the hour. What a great person, glad we bank with b of a.

Join this class action lawsuit against Wachovia Bank, N.A.

Read a letter from the U.S. Congress dated May 27, 2009 against overdraft fees and a threat to the banks about reforming these fees:

Read the FDIC report issued on November 2008 that uncovers a “re-sequencing scam” Wachovia and other banks implemented to rob consumers of their money through overdraft fees:

I use online bill pay at BoA. While making a payment on my AMEX I hit “next day” payment by mistake, which resulted in money going out of my account a day before my paycheck was deposited into it. By the time I realized what I’ve done it was too late. This resulted in $140 overdraft fees for 4 transactions. For the first time in my 6-year history of being a BoA customer I’ve been punished by these fees. I called 704 line and didn’t get ANY HELP AT ALL. The person I talked to told me to talk to Customer Service and Supervisor if necessary, and that the decision to refund any or all fees was all up to them. Like they didn’t work for BoA at all. I don’t know what is going to happen, but in the past when BoA would screw up they would say “we apologize for the inconvenience” and that would be it. However, now that I’ve made an honest mistake they don’t want to work with me. I am on hold with the CS as I am writing this post, lets see what is going to happen.

Nope, they were not able to help me. They said the only fees they refund are the fees made due the bank error. I am going to start looking for a new bank.

    Does anyone have any suggestions?

Well I have to thank whom ever put the (704)386-5687 it really worked. I didn’t get any guff from the man. I hope that more people call this number and get there money back. I got $105 back and I was in a desprite situation if I didnt get that money back. However, they make it noted that it is a one time only thing so please keep that in mind. I am closing my account on saturday and opening one with another bank hopefully not ever having to deal with the 1000’s I have paid BOA over the years. One mistake coasts you 35 bucks and I find that srupid. Thank you so much to who ever put this number. I wanted to write and show that it still works.

That was awesome. Although the bank would not admit fault in the account getting so messed up, they did credit 5 ($175) of my overdrafts back to my account. Just call the #704-386-5687.

Yes, this did work. I think if you explain calmly and politely what a mess you might be in they will be compassionate. They helped me and reversed $153 — account maintenance fees and a couple of over drafts. I will still be closing down my account with BofA however because they are truly evil in my opinion. I did not know for instance that they are funding some of he worst environmental disasters on the planet, the Alberta Tar Sands check out this website for more info

    Wow.

    Wow.

I’m completely speechless. To say the least, I was terrified of calling this number. But after having 3 overdraft fees of $35 each after a stupid mistake (mine, not theirs), I had to take the chance! $105 feeds me, my husband, and toddler for a week! We’re on one income due to a layoff, and as much as I hate begging for money back, I had to swallow my pride. One has to eat, right?

So I called the 704 # today, explained the situation (which it was my mistake completely – scheduled a large bill pay a week too early), and within 5 minutes all 3 fees were credited back to me. Jennifer there was sooo nice – probably the nicest person I think I’ve ever talked to in ANY customer service department.

I didn’t believe it would work, but it did.

Thank you so much to the original poster of this #!!

I called today and spoke with Jose who refunded us 6 of 9 overdraft charges. Though he would not admit the overdrafts were due to the bank deducting money from a fradulent transaction I was refunded the majority and I’m pretty happy with that.

Shea ask where I got this number from just said online, one click let to another click and I found it. Much more relive now…but am still closing the account by the end of the month.

I scrambled to get my BofA checking account in order after noticing a mistake but my transfer from another bank didn’t go through in time to avoid 3 $35 overdraft fees. I called the 800 number but they didn’t do anything, I asked to speak with a supervisor and waited on hold for about 15 minutes. The supervisor was nasty and would not reverse the charges. I asked for the CEO’s address and I was given a different address: PO Box 25118, Tampa, FL 33622. I then asked for a customer relations telephone number but they said they had none. !! I called 704-386-5687 and a lady named Cathy reversed the charges after explaining that I should keep a written account of my transactions and the online access was only a “tool.” What a relief!

I was prepared to send a letter to the CEO, Mr. Lewis, but I hesitated when I read that people didn’t always get a respond. I decided to contact the number provided for the executive customer relations, and I am glad that I did.

I was charged $210 of overdraft fees due to a 3 day hold on my deposit. I was unaware of the hold since it was deposited through the ATM, so I called the 704-386-5687 number provided and was fortunately able to reverse the charges. The reason was because when your deposits are put on hold during an ATM deposit, a notice is generated and the bank is required to notify you promptly so that you do not incur overdraft fees. The representative tried to track down when the notice was mailed to me and apparently, it was not mailed out. The representative I spoke with was very helpful and even suggested ways that I could avoid going through this problem again.

Thank you David for providing this information to the public.

My eBay fees were processed through paypal on the 15th this month (instead of the usual 17th of the month) causing 5 prior debit card transactions to “bounce” resulting in $175 of overdraft fees. I tried BOA customer service and they said it was impossible for them to remove the fees since it wasn’t their fault – even though they moved the larger Paypal payment ahead of all 5 PRIOR transactions so they could charge me the 5 extra $35 fees. That’s their “policy”!

After reading the posts on this thread, I noticed that calling (704) 386-5687 to get the fees removed worked for some people, but not for others, so I decided to give a try. The first woman I talked to said there was nothing she could do and transferred me to customer service which, of course didn’t help so I called again. The second woman I talked to did the same thing so I waited 10 minutes and called again. The third lady I talked to did the same thing too so I waited 30 minutes and decided I would try one more time (figuring I would hang up if any of the 3 ladies I already spoke with answered the phone) and told the 4th woman that I was trying to remove these fees and kept being transferred to Customer Service and getting disconnected. She was more than happy to help and removed all 5 overdraft fees.

The reason I’m adding to this thread is to let everyone know that if at first you don’t succeed – keep calling back! They can remove the fees, even though they say they can’t, even if it’s YOUR fault!

I called the CEO’s office and an executive representative – Robert – said “Are you are who you are calling?” almost angrily. i said i was and explained that I had overdraft protection, so why do I always get multiple 35.00 fees, and he said “What do you mean? You agreed to it.”
I said “where did i agree to this?”
he said “in the documents you sign to open these accounts – you agreed to this business arrangement.”

do any of you see why the voracious greed of large institutions requires REGULATION of fair practice? I mean, seriously to all you republicans, we would all wipe each other out with greed and cutthroat living if our gov. didn’t step in and stop predatory practices. same with credit cards.

I didn’t get all of my 263 in over draft fees back but I did get half! Which I say is pretty damn good considering that if you just call the regular number you might not get that back if anything at all. I won’t say the name of the lady I spoke to but she broke down the process to me and offered to refund half of the fees ONE TIME ONLY.Which in my case was fine with me!

Thank you so much! I am a student and I got 10 $35 fees when I was travelling around. I do have money, but this was ridiculous. The banking center didn’t do it, the online help-line didn’t do it, so I called the 704 number and it worked. I have to pay only 2 fees now. Just be adament that you can’t pay and they should take them all out of your system. It works!

This really WORKED!!! I had 7 overdraft fee’s I check my business acounts everyday and yesterday I woke to the surprise I had 7 overdraft fees charged to my account. I freaked out! I asked my husband to please go to BOA and threatend them to close our business account with them if they do not do something about this matter. What happened is that on Friday of last week I made a check out for about 400 and during the weekend I made some purchase. On Monday when I checked my account everythin was ok the check had not gone thru and purchase for the weekend were still in pending state. On tuesday some .32 fee was added for credit card transaction fee for the restaurant and that was also in pending state. On wednesday monring all these fees that were pending were all overdraft. IN RED! And no longer pending these were all charged as overdraft items I was confused these fees were all first why did the check get processed first! I was MAD and calling everyone I could at BOA went to the actual branch spoke to manager and nothing could be done. Manger at branch told me she could not do anything and only refunded 43.00 worth of all the 245 that was charged in my account. I googled “how to get over draft fee back from BOA” and this popped up. I called spoke to “Jose” and he was godsent he immidiatly refunded 6 out of my 7 overdraft fees. I’m so happy he was so nice and friendly and explained in detail how bank of america work regarding overdraft fee, not that I agree but now I know there system. THANK YOU so much for posting this up, it really helps and in this economy every penny counts.

    Thank you

THANK YOU, THANK YOU, THANK YOU SOOOOO MUCH!!!! I was very worried and nervous. I didn’t know if it will really work. I called the 706 number and talked to a Marcela over the phone. I explained to her our situation being in a single family income and that the cause of the overdraw was totally my fault. After a few minutes of talking to Marcela, she verified and reviewed our account and found it to be in good standing and have no NSF charges whatsoever. She did emphasize that this is also a “One-time” courtesy refund and that if we ever get any more future NSF charges, that they will no longer be able to credit it back to us. She told me that the credit will be effective today and that the courtesy refund will be noted in our account. She went ahead and refunded $385 worth of NSF fees! I was shocked and couldn’t believe it! I couldn’t stop thanking her. I went back online and sure enough there was a credit of $385! Our account is now back in good standing!

Thank you again for sharing this information with us. Now we’re able to pay our monthly bills, mortgage and buy food our my babies.

  30. August 3rd, 2009 at 13:54 | #30

    Success!

I made an honest mistake on my ledger and failed to subtract an entry. I called customer service and asked them to refund the fees ($3x$35). The agent told me he would submit it to the board and that they would give me a “yes” or “no ” answer that is not negotiable and would be final. He asked me nothing about how I came to have the overdrafts and he did not review my history. I have been a BofA customer for 10 years and am not in the habit of bouncing checks. I simply failed to deduct an entry on my hand-written ledger because I wrote two checks to the same person, and for the same amount, with no other transactions in between, and I entered them on my ledger right where the fold is. He waited less than one minute for a “reply from the board”, which I didn’t believe for a second. The response was “NO”. No refund of any kind. Nothing to be done. Period. I said I would close my account. He politely, and even cheerfully replied “just make sure you have a zero balance first and we will be happy to close your account for you”.

I read this thread last night, so I didn’t panic. I called 704-386-5687. The phone was immediately answered by the friendliest woman I have ever spoken to on the phone. Her name is Kathy W. James. She quickly and politely reviewed my account, saw that I have been a loyal customer for 10 years, asked me a few polite questions, and granted me a full refund of $105.00. She was so polite, so caring, so friendly, it make me feel all warm and fuzzy in my heart. She asked how I got the number and I mentioned I found it on an online thread on the subject.

I took her name and the address of the CEO in order that I might write a kind letter to him to express how helpful Kathy was to me. I don’t know why this bank makes you have to go through the back door and know the secret knock before they do the right thing. The first guy I spoke to was polite, but he was trained not to give a damn and to automatically decline refunds without budging. The song and dance about “submitting it to the review board” was nonsense. There was no review. Kathy is the one who reviewed my case, and only after I called the number this thread provided.

See, people think that just because they don’t pay bug fees (my checking account is free), the bank isn’t making money on you and they can afford to lose you as a customer. The truth is, the money you keep in your accounts are an asset to them. If you withdraw your money and close your account, they lose a lot more money than you think, even if you don’t have much in the bank. They aren’t doing themselves any favors by charging honest people so many fees just for a simple error in book keeping.

I wanted to share my experience with all of you, first to thank you for sharing the “secret knock” with the the world, and second, to let everyone know it worked. :)

    Warmly,
    Alexis

Words cannot describe how grateful I am to you for providing this information. I knew that obviously i was not the only one who was getting robbed by BOA but i had no info that could help me and my local banking centers seemed to be manned by tellers and managers who used to be tellers and have no way of doing anything but hanging their heads in shame when you explained your problem with these fees. I called the 5687 number, spoke to a very nice woman and she not only refunded $400 in excessive fees but also helped me with another account I had fees on and have been trying to close for over a year!

Thank you so much for the info!!

Over the weekend I charged 4 different items ($16 in total) and was charged $140 in overdraft fees. I called the branch manager, nothing. I called the 800 # on the back of the card, nothing. I found this site and called 704-386-5687, I spoke to Jose and got the OD fees back! I was skeptical at first but it does work.
They do however not your account so this is a one time deal.

Thank you so much for this information. It is a God Send. I have now been awarded back 105.00 of the 140.00 fees that were taken from me. Please understand. I advised her that I understood and took full responsibility for one fee..I was not trying to rip the bank of. She explained to me the error and why it happened and told me that as a valued customer they would prefer not to lose my business as I stated was going to happen. She told me this is a one time courtesy and provide the credit.

Ok.. I was skeptical and really nervous to call this number but I did and talked to a super nice woman named Yolanda. She asked me if I had talked to customer service (I fibbed) and then asked what my situation was. Told her the truth that I was on vacation and messed up thinking that my iPhone app was 100% accurate in reflecting my current balance before pending charges had gone through. I was in a remote area with bad cell phone service so I couldnt check often. Long story short, it was an amazing customer service experience and she refunded all $175 to me. She did mention that all customers should keep a ledger of their expenses and to familiarize themselves with the fee schedule for overdrafting… Hope this helps!

Awesome! I have a phobia of the phone so I typed a letter on my computer and mailed it to the attention of Nancy Condos at 100 N. Tryon Street, Mail Code NC-1-007-18-01, Charlotte, NC 28255 on 8/9/2009. Today, less than 2 weeks later, I received a voicemail message from a gentleman at the Executive Offices who thanked me for my correspondence and stated that as a one-time courtesy, they had reversed the 2 NSF fees that I recently received and had already credited the $70 back to my account. And I checked my account online just now and it’s true, the money was really returned, much to my surprise. Thank you for this post and this web site!

I thought for sure this site was some sort of scam but I sware it worked! I spent almost 2 weeks trying to get someone at my local branches to help me and nothing! They took over 500.00 from me in one weekend. Debits I used on Friday showed on my account immediately but on Sunday when I put my hotel bill on my debit they rearranged 12 different transactions and paid that first. I was charged 35.00 for a 1.30 cup of coffee! I couldnt sleep, couldnt focus and was seriously depressed at being ripped off so badly. I called this number and within 10 minutes this nice woman refunded 6 of my charges! I cant thank you enough whoever set this site up. This is not a joke and definetely not a fake phone number. This woman explained everything to me and didnt use some scripted language like everyone else at this horrible bank. I also now tell everyone that pays with a Boa credit card at my office to get rid of their account. I hate this bank and will jump in line to start a class action suit at any time.

it really works. I called the 704 number and they were really nice and refunded 140 of 245 in fees I told them it was my fault that I was not keeping track and they still refunded the $ to me. When I call customer service they always say there is nothing they can do even for an overdraft of under a dollar.

Thank You very much. I tried battling with customer service and onsite bank manager but they gave stupid standard responses and made me look like an idiot. I called 704… number and voila I got refunded my overdraft fees…Thanks a lot for posting this information

I forgot about $30 worth of misc. charges on a Sunday. On monday I was notified of this and I made a deposit to bring it positive + $150. Tuesday I got 6 overdraft fees which wiped out all my money again.

Today I googled “get bank of america fees reversed” and low and behold – found similiar sites to this.

At 1:02pm I called that 704 #, very nice lady answered…i remained calm. She asked how she could help me so I told her (calmly) that is was an honest mistake and I don’t know how it happened. She asked me how I normally keep track of my charges and I told her a check register and online. Her response, “Well _____ I am going to reverse those over draft charges this one time. We do thank you for keeping track of your purchases that way, not many people do. But mistakes happen.” We then talked about misc. stuff while she was crediting it.

    Thank god for google! lol

How to get overdraft fees refunded to you.
I wrote the following letter to the Bank of America CEO and to Nancy Condos VP/ Customer Advocate, and it WORKED!!! We were refunded the entire $185.00 of overdraft fees. Just received a call today from a BAO rep, two days after I sent the email and also mailed the same letter. I am including a sample of the letter so you can use it as a guideline for yours. Remember to be honest and mention the current economic situation the country is in.

    ********************************************************************************
    Dear Mr. Lewis:

On August 21, 2009 (Friday), Bank of America received three (3) transactions which caused our personal account to become overdrawn. Because of this, as of today, my wife and I have been charged $185.00 worth of overdraft fees and overdraft protection transfer fees by Bank of America.

These unexpected charges by Bank of America on our account were caused by an innocent oversight on my part, when I misplaced my checkbook and failed to account for check# 1467 in the amount of $307.90. Because of this oversight, purchases that we HAD to make (e.g. Wal-Mart – for my son’s return to school supplies and FACTS/Valencia Community College – for my son’s tuition) resulted in our account becoming overdrawn.

Upon realizing what had occurred, we gathered together $100.00 and made a deposit the next business day, August 24, 2009 (Monday). Knowing that the U.S. Government pays me on Wednesday, August 26, 2009, we anticipated no more than one (1) overdraft fee of $35.00. However, we were astonished to find out that we were charged $185.00 for six (6) transactions averaging $49.21 per transaction.

Now, we do understand that banks have regulations that must be adhered to and we have done so throughout the years as loyal customers. Apart from our personal checking account, we also have a savings account, Bank of America credit cards, two small business loans and, at one point, we had a business checking account with Bank of America as well. We have had direct deposit for my disability check as well as my wife’s paycheck for years to our personal account with Bank of America.

As you know, in today’s harsh economic environment, we find it extremely difficult to afford these charges; especially given that our account went into the red from an honest and simple oversight. So, we are writing to you today, asking if these overdraft fees can be refunded to our account in a show of goodwill towards loyal customers like ourselves. We sincerely appreciate your help.

I hope that you will treat our case with understanding and consideration and we thank you in advance for you time.
    Yours Truly,

    Mario & Jacqueline

I didn’t think this was true, I thought it was a scam. But I actually called and a very nice lady (advocate) helped me understand why my account got those fees. I now know how to avoid them and really track things on my online banking. She said she will reverse my fees this once because it’s a new account and I had made a mistake. Thank you Jesus!
