Get Overdraft Fees Back from Bank of America by Writing to Their CEO

October 18th, 2008 David Leave a comment Go to comments

Bank of America used to be the largest bank by assets and second largest commercial bank by deposits before the acquisition of WaMu by JP Morgan chase & Co. Bank of America’s most popular banking products may be the MyAccess Checking Account and the Keep the Change program. However, there are a lot of complaints about the terrible overdraft fees. Here I will tell you the most useful method to get the overdraft fees back from Bank of America.

Why the overdraft fees are so terrible?

First, what’s “an overdraft fee”? An overdraft item fee occurs whenever funds must be provided to cover a transaction that overdraws the account. Believe it or not, overdraft fees have increasingly become a source of profits. Banks and credit unions collect about $17.5 billion in overdraft fees per year. As reported by USA Today:

In 2007, Wachovia put in place a tool that tells employees how much they can refund to customers hit by overdraft fees. The bank, in memos, also tells employees to “sell” a debit card with every account because it makes money when consumers use it.

Bank of America raised the fee charged on the first day a customer overdraws to $25 from $20. BOA also raised the number of times a customer can be hit with this fee per day to seven from five. It’s really terrible. Furthermore, the next following days after the first day, the fee is $35.00 for each item. A customer can easily get up to $500 fees just for the overdraft. And it’s vry common to pay $100 over draft fees for just 2 or 3 cups of coffee!

It’s common to go to your local BOA branches to complain the over draft fees if it really happens to you. Or you may call BOA up to appeal. However, most of the employees are trained to give you a samll portion or even nothing to you. So there must be other ways to get the money back.

After a little search on the web, I realized that the most effective way to get the over draft fees back is to write to their CEO!

This has been confirmed to be successful for many victims of BOA’s over draft fees. The CEO of Bank of America’s address is:

Mr. Kenneth D. Lewis
100 N. Tryon Street.
Mail Code NC-1-007-18-01
Charlotte, NC 28255

In the letter to the CEO, all you have to do is to state the reason why you have so many over draft fees and tell him that as a loyal BOA’s customer, you hope he can help you!

And there are other methods to reach BOA’s executive customer relations.

I was hesitend to call this number (704-386-5687) after I talked to customer service for about 20 min about how the overdraft fees work, unfairly. The customer service gave me 35 dollars back out of 5 x 35 $, I was very unhappy because I have beeen checking my balance online very carefully, and it never showed minus in balance until after I got my paycheck and I had plenty of many in my account.
I called not knowing what to say exept that I was very unhappy, I didn’t want to go through the whole thing I just said to the CS lady. Sure enough I didn’t really have to say anything , the guy on the phone said he would refund the fees and gave me very good adivce about accounts I could have at BA. I am a happy camper right now ;o)

I called today and spoke with a very friendly fellow and he refunded all of my fees as I had never overdrawn my account before($420). He asked how I got the number and I told him an internet search. They were very nice – Bank of America is back on my good list :)

Start inundating the White House with emails and letters about Bank of America and their practices. “We the people” have to start taking back our power and stop being victims. Demand that the president fight the real terrorists and do something about BofA!

……yes…. this does work… Just be patient, persistent on the phone with them – they have the power to issue a 1 time fee credit on the account provided you do not have a history of overdrafting. I was a customer since 2005 and that helped too. Be polite!! Relaxed, poised and you will eventually get it.

The number posted actually does work. I spent almost 2 hours speaking with an agent and her supervisor about the 3 overdrafts I was charged. It was the first time this had ever happened to me–especially since I am very good about making sure I have the funds in my account and I had made a deposit for the day before (obviously it didn’t post until after the overdrafts). I googled “how do I dispute fees for overdrafts with BoA.” I found the phone number listed for the Office of the Chairman. Surprisingly, I spoke to a very pleasant woman by the name of Lyn. She helped resolve the issue and credited me the $105 fee I was charged. I am shocked that it was that easy…especially since I was told by customer care that “no credit will be issued because it’s standard policy.” By the way, the name of the agent I spoke to was Dashaivue Orr and her supervisor was Lori Lockie (Unit #1580)

Thank you for this number! I have banked with Bank of America since 2001 and never overdrafted my account, so I was shocked when I was assessed $210 in overdraft fees. When I saw I was overdrawn, I immediately set up the overdraft protection to link to my savings and signed up for the low balance alert. I did this when I called customer service the first time and they refused to refund the overdraft fees since it was not a “bank error”. I then called the 704 number and spoke to very nice woman named Lorraine. I explained to her how this was a one time error on my part and that I had set up the overdraft protection and alert as a result. She said that since I had taken action to prevent this from happening in the future and that I had no history of overdrafting before, she would refund the fees as a one time only courtesy of the office of the chairman. I think this will work if you are not a chronic overdrafter and you’ve taken action such as the overdraft protection to show you’re serious about not letting an overdraft happen again. Thanks very much for the advice and phone number! I’m so happy to get my $210 back!

I too wanted to leave a quick post as this saved me a $115.00. I spoke with two customer service reps on the phone, 1 manager, and used the online chat service. My next option was going to my local branch and threatening to close my account (not sure if I would have went through with it however) to have $315.00 worth of fee’s removed. I have previously (4/mo’s ago) had fee’s removed and therefore no one wanted to really listen. I called the number above an explained it was accident, gave her the circumstances (I moved a $1000.00 into savings the day before, etc) and told her this won’t happen again. I do use quicken and it just got away from me. Shelby was nice and refunded me $115.00 and asked that I be more careful. Which I will!

Some money refunded is far greater than none…

    Thank you Original Poster!

I am overdrafted by 27.00 in my account which I realized this morning. I had a check floating around that wasn’t cashed in a timely manner, well it appeared yesterday afternoon thus causing the overdraft against 4 charges. I’m calling as soon as the charges appear against my account. Hope this works, money is so tight right now I can use what ever I can get my hands on. Wish me luck…

Hi..thank you so much for this blog. I read it and was really skeptical but it turned out to be true. I had about 10 over limit fees drawn on my account. I have been with the bank for over 10 years and did not get the help from the customer service line. I spoke with a customer service representative and also a “team manager” out of arizona and it was not helped out at all. I even threatened to close my account. Well, I just called this phone number and spoke with a Juan at the office and he credited me 6 out of the 10 fees. Please call and I know that they will help..thank you soooo much for this!!!

    Hello All,

Thank you so much David for this information. I literally just ended my wonderful call with Nancy M. Condos @ Executive Customer Relations general line: 704-386-5687. There had been some confusion with my .mac account and it had said that I was going to renew (90 trial) so I thought that it meant that I would not be charged for 90 days (what it really meant was that I was already in my 90 day trial, a bit confusing). I had initially had the money in my checking account set aside, and as 2 days passed before realizing the misunderstanding, I got an email (to my surprise) that my BOA account had been overdrawn. It had taken 2 days to show up on my account and by that time I had made a few transaction (all around $2 here and $5 there, max totaling under $20) and I had been charged 4 $35 overdraft fees. All in all, I called Nancy this morning initiating the conversation with the fact that I had a specific situation that required help and that I wanted to explain to her, and she was completely understanding and polite and knowledgeable. She explained to me that I knew exactly what had happened, and that based on a 365 day review of my accounts standing, and based on the fact that this is not a recurring issue for me and that I have done a good job at keeping it in good standing, that she would be able to grant me a ONE TIME refund (of all 4 transactions) and that it would show immediately and be available within 24 hours. This helped me out sooooooo much in my hard times right now, so thanks again David, and thank you Nancy!!!!!!

Thank you!!! My credit card had a $0 balance on it, but for some reason the credit card company decided to take $850 out of my bank account (automatic payments are a BAD idea) and overdrafted my account by alot. I immediately got the transaction reversed and got the money returned, but ended up with 9 $35 overdraft feeds, $315 worth. Called BoA cust. service and they said it wasn’t their fault so I should file a claim. Called c.c. company and they said it wasn’t there fault, so I couldn’t file a claim (needed them to admit fault). One friendly cust service agent at BoA offered to refund $200 as a courtesy, which I accepted, but still didn’t think it was fair to have to pay the remaining $115 for something that wasn’t really my fault. Called the 5687 number and was refunded the other $115. Rep was very nice and just asked me to cancel my automatic payments and close the credit card. NO PROBLEM. She also asked where I found the number, and I said google search.

Thanks so much for the number!! Hopefully this mess is now over!

dude. I can NOT believe this thing worked! I have just CALLED THIS NICEST LADY EVER AT BANK OF AMERICA CALLED KATHY! SHE IS THE SWEETEST PERSON I HAVE EVER SPOKEN TO AT BANK OF AMERICA. I had a domino affect of fees starting with an overdraft of fifty two CENTS! and it had escalated to over 200 dollars in overdraft fees. Me being a college student gradating in may and starting a masters program soon after that, currently unemployed searching for a job COULD NOT AFFORD THESE FEES and she graciously explained the reason behind the fees and expressed the available balance history on the left of the screen on online banking and it really breaks down the authorization holds that are on your account. OMG. I can’t believe that they actually aided me in helping me organize my banking program. this number works when you are at your wits end. although it is a ONE TIME ONLY thing. it works and I am THANKFUL I HAVE FOUND THIS NUMBER. THANK YOU ALL!

Nancy Condos email does not work. I faxed a letter to Walter Massey, chairman of BOA with a copy to Carolyn Maloney, congress person who is working to stop abuses of credit card customers after a half-hour tirade by a so-called customer service representative. I called to explain I had not gotten my bill in the mail and wound up with a fee assessed despite an excellent track record since 1986. Then, my credit line was cut in half!

Just called the Office of the Chairman and the CEO to get overdraft fees reversed, due to a misunderstanding on overdraft protection.

thanks to this link… i just now waived my overdraft fees today…. i spoke to them and they said that they can only remove only 8 of 11 charges… but still thats 300 bucks…. i am fine with it but still if i could have removed all my OD fees, that would have been even better… it was my friend’s mistake that he did not transfer money and i got all charges… if anyone know how to waive all of 11 OD fees then i would love to call them back to get it waive off….

    Thank you all!!

It works! Just called. Twice. The first time was unsuccessful, she just gave me a lengthy reason as to why my account had so many overdraft fees (duh, like I didnt know) and I hung up. I called 10 minutes later and got a very nice woman who did give me a one time free courtesy overdraft lift, over $210. It still put me under due to the Returned Item fees that popped up (my idiot linked account kept attempting monthly payments when Id thought i canceled it, twice daily), so i wasnt forgiven those, but $210 is still $210. My advice: Be persistent. My first time went nowhere. My second did.

Thank you so very much! This really did help. I called the office of the CEO.
They were very cordial; I was on the phone with them for approx 25 minutes while his assistant goes over their practices and my future options in preventing an overdraft.
He also explains the reason why the “Big amounts” typically clears before the smaller amounts. According to him, customers were polled and majority prefers their mortgage payments or car payments to clear before their Dunkin’ Donut transaction.
He was able to consider my good standing with the bank and credited 6 out of my 8 overdraft fees ($210). Bank of America is no longer on my “Evil” list. Also, thank you so much mycardblog.com for hosting this site and providing this valuable info for all.

I just called and got $280/fees posted back to my account. I actually had a legitimate excuse – my employer deposited my pay into another employee’s account causing my account’s pending items to go into default and overdraft. I didn’t realize the paycheck did not post until the next week (this week). My employer furnished a letter to me to give to my bank. I called the number provided and the rep was VERY VERY nice and refunded ALL of my overdraft fees. Oh my god! I was so happy I nearly cried. I’m still shaking, I can’t believe it. I didn’t even have to provide the letter. I’ve NEVER been treated so nicely by a Bank of America representative before. I’m still holding right now, but WOWEE!!!! Thank you David!

spoke with quinn, after 20 minutes on how she told me its my fault she gave me back 6 of 13. they are well aware of this website and she sided with the bank the entire time. bunch of crooks, i take solace in karma, they rob the american people and make us feel like it’s our fault. she reprimands me for not keeping a check register, uhhh didn’t skank of america just take billions of taxpayers money to bailout their own lack of a check register, classic. see these people think they have a noble job but in fact they are thieves in suits. I just feel bad for their parents, that they have such nefarious children.
