Get Overdraft Fees Back from Bank of America by Writing to Their CEO

October 18th, 2008 David Leave a comment Go to comments

Bank of America used to be the largest bank by assets and second largest commercial bank by deposits before the acquisition of WaMu by JP Morgan chase & Co. Bank of America’s most popular banking products may be the MyAccess Checking Account and the Keep the Change program. However, there are a lot of complaints about the terrible overdraft fees. Here I will tell you the most useful method to get the overdraft fees back from Bank of America.

Why the overdraft fees are so terrible?

First, what’s “an overdraft fee”? An overdraft item fee occurs whenever funds must be provided to cover a transaction that overdraws the account. Believe it or not, overdraft fees have increasingly become a source of profits. Banks and credit unions collect about $17.5 billion in overdraft fees per year. As reported by USA Today:

In 2007, Wachovia put in place a tool that tells employees how much they can refund to customers hit by overdraft fees. The bank, in memos, also tells employees to “sell” a debit card with every account because it makes money when consumers use it.

Bank of America raised the fee charged on the first day a customer overdraws to $25 from $20. BOA also raised the number of times a customer can be hit with this fee per day to seven from five. It’s really terrible. Furthermore, the next following days after the first day, the fee is $35.00 for each item. A customer can easily get up to $500 fees just for the overdraft. And it’s vry common to pay $100 over draft fees for just 2 or 3 cups of coffee!

It’s common to go to your local BOA branches to complain the over draft fees if it really happens to you. Or you may call BOA up to appeal. However, most of the employees are trained to give you a samll portion or even nothing to you. So there must be other ways to get the money back.

After a little search on the web, I realized that the most effective way to get the over draft fees back is to write to their CEO!

This has been confirmed to be successful for many victims of BOA’s over draft fees. The CEO of Bank of America’s address is:

Mr. Kenneth D. Lewis
100 N. Tryon Street.
Mail Code NC-1-007-18-01
Charlotte, NC 28255

In the letter to the CEO, all you have to do is to state the reason why you have so many over draft fees and tell him that as a loyal BOA’s customer, you hope he can help you!

And there are other methods to reach BOA’s executive customer relations.

I tried the email address for Ms. Condos, it does not work anymore. I called the (704) number and was instructed to send a letter by fax or by mail. I faxed my letter to a Ms. Norma Adams at FAX (704) 386-6699 on October 23, 2008.

Thank you so much for this! I spoke with someone in Customer Relations named Valerie Merk and she refunded my overdraft fees that totaled $140, she was very kind and helped me solve my problem. I wrote a letter to Mr. Kenneth and an e-mail to Mrs. Condos, but no one replied. However, Mrs. Merk told me that Mrs. Condos was out and not available because she was gone. Bank of America is reliable and if someone can’t help you, keep on trying! Thank you for writing this article!

Man this is so awesome. I had $140 from BOA in overdraft fees..and i called 704-386-5687. She was going to transfer me to customer service but I quickly just told her what the problem was and she said “Why don’t I help you right here”. I got the $140 back!

    David,

I already tried to write the CEO about excessive overdraft fees drawn from my account, several times, and they refused to help me. Bank of America was charging me sometimes $600 per month from May to August 2008. I advised them that I had been a loyal customer for years and never had this problem. They blantantly refused to help. Finally I went down to my local Bank of America, Inc. and the representative said that they DO NOT under any circumstances re-credit fees. I asked to close my account, and she would not unless I paid the $250 overdraft. So now I’m facing a credit problem with Chex Systems because I can’t pay the money. You should also know that customer service refused to provide me with the name and address of their CEO so I can complain. I had to find it myself on the internet.

Dear California Bank of America Customers:

I’m investigating a potential consumer class action against Bank of America relating to overdraft fees based on violations of the California Unfair Business Practices Act and Consumer Legal Remedies Act.

Please give me a call to discuss the possibility of becoming a named representative. Thank you.

Thank you so much for giving us the CEO.s adress and phone number. I had $350 in overdraft fees and I decided to write a letter to Mr. Lewis’ office. Well, guess what? His secretary called me and refunded all the fees.

THANK YOU SO MUCH FOR YOUR HELP.

p.s. For other readers, when you write a letter to the CEO, make sure you apologize and admit that you some how made a big mistake, in other words, make the CEO office think they are forgiving for averdrafting your account; Hey, look at it this way.. As long as you get your money back…..

Hello and thank you so much for posting this information. I have been pleading with Bank of America since November 18th to help me with their ridiculous overdraft fees. Today, January 15th, after finding this blog site my problems have finally been resolved.

I accidentally overdrafted my accout by about $400.00 and I was charged $720.00 in fees for it! I have paid what I can every week and I have called every number that I could get my hands on at BOA every week to explain to them my situation and to try to get any help with the fee amounts. I was always told no, please set up a payment plan with such and such number..

Well Today I call the (704)386-5687 number. The first time I called I got no answer and no voicemail and not even an automation letting me know that I had called a BOA line. The second time I called a very nice woman answered the phone. She asked for my account info and reviewed my account and account history and saw that this was the first time that I had ever done anything like that and that I was charged way more in fees than what I had overdrafted. And after looking over the account for about 10 minutes ahe told me that she would be able to refund half of the $720.00 in overdraft fees! I am elated. Now my account is at a postive balance since I have been paying on the fees since I got them…

I cannot thank you enough for posting this information!!!!! Thank you thank you thank you.

And for thos of you who have not yet been helped and feel helpless… trust me I was so there today before I did a google search and found this site. I know it sounds too good to be true but trust me, it is soooo worth a try!

Ms. Condos no longer accepts emails from outside the company. Apparently she got swamped. I am in contact with Shauntay at the general ECS line. She is supposed to be researching my issues with a force closed account and getting back to me within the next couple of days.

I just received $172.00 in overdraft fees for five transactions and the bank refused to do anything for me I called the (704)386-5687 number like everyone else here less than five minutes ago and i spoke with Anna at the executive and office of the CEO Ken Lewis. I explained who i am and my situation and why my account was overdrawn admitting fault but also letting her know that if i had known i would have just transferred money from my savings account which had money to cover the overdrawn amount. Anna was very very nice and i am greatful for this site for giving me the means to contact them because she did tell me she will refund the entire $172 because she understood my situation and that i will see it show up as a credit by the end of the day. She did say though and its important that others keep in mind that IT WAS A “ONE TIME COURTESY SHE GAVE ME BY THE EXECUTIVE OFFICE” and that the only time it would be done againm is if it was a bank error. I reccomend this number though to anyone who may have fallen short due to hard times and incurred a ton of nsf fees making your situation worse than it already is……… ]

    Thanks Guys!!!

I called the 704 number today for 140.00 of overdraft that was on my account. I revealed that I did already call customer service and spoke to a supervisor. All I have to say is that this will help. I was given back the entire amount and I am so happy because these days this is a lot of money. Make sure you call customer service first so that is shows that you tried another route. Plus do accept some acceptability.

    good luck

I just called (704)386-5687. I honestly didn’t think it would work. In the past hour I’ve called the customer service twice and been to a local branch with no luck. I spoke to a rep of the executive office and without even explaining anything, I just asked for a refund of the 120.00 in fees I was charged, and it was returned, no questions asked. Thank you, thank you to the person who posted that phone number!!!

David: I can’t thank you enough for posting this information. I just called the 5687 number and spoke to a very nice young lady who credited me back $350! I’m actually in shock – if you knew the amount of time I’ve spent at my local branch and on the phone trying to plead with this bank and yet, all I did was call, explain my situation, (which I don’t honestly think I needed to do), but I felt that was fair, and she just credited the fees.

    Bless you!!

Hello! Thank you so much for this information!!! I just called the BOA # and got the VP. She was extremely nice about refunding my 70.00overdraft fees. She also wanted to know where I her # from. Anyone know why she wanted to know that information? Anyway, thank you so much for the # to get my fees refunded. BOA is alright with me for now!

The situation was that I logged onto my account last night and noticed that I was in the red; I quickly transfered money over from my savings to cover the red. Yes it was my error in lack of not balancing things correctly. This morning, all the over draft fees were posted, totalling $245. I about dropped. I called customer service and explained, they could not help, I spoke with supervisor and he could only help minimally. I did not want to be embarrassed by trying the number above, but when times are so hard as they are now for me and my husband, I made the desperate try and called the #. I spoke with the most understanding gracious woman on the phone, who spoke with me as if we have known eachother and she gave me great advice as well as the ultimate and that was waiving all fees. Even with this being my fault, I was humbled that someone actually gave me a break today. I honestly take the woman’s kindness and advice with great gratitude and will not make this mistake again. I hope people do not start abusing this option, as there are truly people out there that need this break and I hope that the bank continues to help those people.

I have recently had this overdraft problem with Bank of America. I found a number online and it was said to be the CEO’s office number. I didn’t believe it was true, then I actually called and I spoke with a Ms. Freska. The bank had not only posted my items in amount precedence, but when I had gone into the bank before the money was posted in my account I was charged 3 $25 each transactions stacked one right after the other! My receipt for the deposited money was mark the same day right before they took out the $75 from my account and then told me that I had came in the day AFTER and deposited the money!

Needless to say I was on the phone with Freska for 45 minutes and explaining to her that not only did I attain her office number from a Google search, but that I also found and talked with two lawyers who have a lawsuit against Bank of America. My $75 was deposited back into my account with a 6 month wire transfer fee waiver.

Below is the number for one of Bank of America’s CEOs

David- THANK YOU!!! Thank you from the bottom of my heart and wallet! I just called 704-386-5687 and spoke with Mrs. King. I had actually closed my account last week because of all the overdraft fees they charged me. I went into a branch and demanded they refund all the fees but they wouldn’t. I found this post a few days ago but was scared to call the number because I had closed my account and didn’t think they would be able to help me. When I spoke with Mrs. King, I told her that I was a student and had miscalculated my spending which resulted in all the overdraft fees (I had six!) After talking with her for about 20 minutes, she reopened my account and refunded all six overdraft fees. She was so nice- the nicest Bank of America representative I’ve ever spoken with.

She told me that it will take one full business day for my account to be back in “open status” and for my refunded fees to be available (“happy”- I wouldn’t worry).

I seriously cannot say thank you enough. THANK YOU!!!!!!! Thank you! thank you!

I am sooo Happy! i had about 8 $35 overdraft fees due to my error last week and I call the 704 number and she took off 5 of the 8. I started out with going to the branch and calling the regular customer service and they said they could only take off one because I have a student checking account and I have a courtesy service called “stuff happens,” they’re crooks and should be calling it “thing happen!” Thank you so much for the blog. I had called ceo # and they said they could only take off 5 of the 8 fees which is much better from the last. Once my checking and credit card gets in order, I’ll probably move to a credit union for better customer service the next time something like this could happen but I’ll probably use cash for everything i do. Thank you credit blog!!!!

I called the 704 number, and a very nice lady picked up my call. I explained my situation to her – i had 8 overdraft item fees. Previously, I talked to an online specialist and they refunded 1 fee for me, so I had 7 outstanding. I told the lady I am willing to pay for one or two, but truly not 7, because I really couldn’t afford it. She was very very nice, she said I could have 5 refunded. I mean, maybe the bank is harsh in the first place for charging such a high fee, but then we should always keep track of our own records, and maybe link our checkings to savings with a protection plan. Anyhow, if this is how the corporate world works, we have to learn how to survive…

I never usually reply to these things, but I was so pleased with my results I had to let everyone know. I had almost $800 in overdraft fees spanning about 4 months. I called 704-386-5687 and spoke to Sally and she refunded me everything except for one fee she made me responsible for. I got $700 back! By far the best customer service experience I’ve ever had.

Just tried the 704, got a very nice lady, who was able to help me. I went over on my account by $8.00 on 4 different transactions($140 in overdraft fees). I called and told the lady that the insuffient funds were my fault and were mistakes made by me. She talked to me for about 15 minutes, asking questions, and was able to help me. She refunded the entire $140 dollars with the promise that I would watch my account more carefully (which I definitely will, these overdfraft fess are outrageous!).

I just called the number after seeing this site. after many arguments and disagreements with branch managers and the like over many overdraft fees i have been charged in the past i decided to give the 704 number a try after reading all the positive feedback on here. after having the rep look at my account history i thought i was screwed and would not recieve anything back because i had so many prior overdrafts. but thanks to mr lynch who i spoke to he gave me back the last six overdraft harges i had incurred dating back to my last paycheck. this got me 210 dollars back!!!!!! i cannot thank whoever started this site enough because that was money i had chalked up to pretty much being robbed from me. the rep did make sure to say however that this was a one time courtesy and would not happen in future

I just finished calling the 704-386-5687 number after having over $200 in overdraft fees assessed for $36 in overdrafts. Needless to say I am not a happy camper. I did not find ANY RESOLUTION by calling this number. I was very gracious and civil and the representative I spoke with would not budge. Anyone have any more advice?

I have another business account with them and they appear to care less. I have barked up every tree so far and have not had any success.

I just called because I got in the read because of my error. I called and stated my case and they said they would credit my account the $300 that was taken from me. At this time it hasn’t been processed but I believe it shall and will updated this note when it is. I had to admit it was my own error but that the price/cancel card is too much/doesn’t happen. I am very happy with the way things turned out and I’m waiting for my account to be credited (again will post again when it does). Thank you for posting this because it does work, Friendly people too, so much so I left a voice mail with my person’s boss telling him who greatful I was for having her.

I’m back and I got the $300 back into my bank account. It really works, just have to tell why you are in the red. It was my fault but the women, Lynn was very understanding and helpful.

YOU ARE MY LIFESAVER!!! I have over drawn before because of a bank error and this time when I did overdraw it was my own fault no one would help me. I’m in college and I had to borrow money just to be out of the red and by the time I got home I had another 3 $35 charges totaling now 7 $35 charges!!! I literally have no money to eat now until next month. My boyfriend told me to google how to get my money back and I stumbled upon this! IT WORKED. One time thing from the office of the CEO. I’ve never been more nervous in my life but it truly WORKED!!! I’m getting $210 back by 5 PM today thats all but one of the fees (which is how it should be!)

Yes. 704 number. Judy? Very helpful, saw that our overdraft fees were a real mistake, makes me feel proud that there are folks who can help us in tough times. I was very appologetic, mentioned BoA has been there for us with services and availability for our needs, would be a shame to not have them around, and she quickly reversed the fees. I had explained that I also paid fees on overdrafts that were my fault, knowing that we all make mistakes. So, thanks everyone for this tip. I would suggest be as nice about it as you can, even if they don’t help 10% of the cases, having this available for the rest of us is great.

Overdraft fees are ridiculous. I hate that they come up with this terrible way to make money.
They charged me $105 and I went to local branch to dispute the fees. After long wait, I finally spoke to the representative, but they wouldn’t waive the fees. I was so worried how I was going to pay bills and fees… I was going to the different branch but fortunately I found out this blog, I called 704 number, and I’m getting $70 back… not the whole amount but it’s ok. I’m so relieved.. Thank you so much for the info!!! You saved my life!!!!!!!!!!

I have been a customer of Bank of America for about 10 years, and never known them to be this flexible and agreeable. I agree with many of the prior writers….just called at 5:45PM today and got $305 overdraft fees refunded to my accounts. A prior partial reversal had been given yesterday by the regular toll free customer service. However, the 704 number did better. She gave the remaining refund back to me. She was very pleasant on the phone…..quite surprised I must say about Bank of America.

I had a different problem. I got a new job and had to relocate so I called all my creditors to ask for short term relief from my monthly payments. All of them were more than willing to do so except BOA. In fact after I spoke to them on the phone, they cancelled my credit cards! I called them and went off. After reading this site I decided to give it a shot and call and see if they’d open the accounts back up. The lady did speak very politely as she uttered the company line like the mindless bafoon she is. I had been in good standing with those cards for almost 2.5 years, always made larger than minimum payments etc…
I told her BOA will never see another penny from me. I have no assets, no house, no stocks or bonds, no 401(k) to raid. The buck stops here. I’m filing my own suit against BOA. It’s called just stop giving them my money.

OMG! This advice really works. The customer service rep was very helpful once I explained that I was unaware that my check card would still run transactions even if I did not have sufficient funds. I also told her that I set up alerts, transferred cash to my savings account, and connected my checking to my BOA credit card to prevent this from happening in the future (all of which are true). As one of the bloggers suggested earlier, I also made sure to bare the weight of what happened and did apologize for not realizing this. However, I also expressed that I would appreciate having the fees reversed, especially given the recent action I had taken to prevent this from happening in the future. BTW, who wrote this article bc I sooooo grateful. PS: I called the 704 number.

Well gang, I have a doosey – over $600 on 18 transactions spanning 5 days with no communication from BofA until 6 days later in the mail. TOTALLY UNACCEPTABLE. Especially unacceptable when I am a 20+ year customer. I’ve had a couple slips in the last year so they wouldnt refund the amounts at a Branch Manager level. Keep in mind, my slips have been very few in 20+ years, all the while depositing over $15k monthly in Direct Deposits. I mailed a letter to the CEO last week and havent heard from anyone. I called this morning and left a message. However it turns out, I’ll let you know…

Calling the 704 number worked for me also. Lady on other line was curious as to how I got the number but I did not think it was necessary to give source.

I called the 704 number and Erica was nice enough to refund 4 of 7 OD charges. As much as I hate these (even when they are my fault), it is important to keep good records of your account to prevent the OD charges.

It does work! The lady from NC was super nice and actually treated me like a valued customer. My biggest problem is that nobody at the 800 number and the banking center cares about you, they read you a script, tell you that they “value your business”, “they understand your frustration” but I don’t see results. I was on the phone the entire day trying to get my money back before I learnt about this corporate number.

My issue is that a charge from Thursday went thru the next Monday and because of holds and whatnot it caused 6 overdraft fees. The misleading part is that the “Available Balance” online said that I had plenty of money and the back of my checkbook said I had plenty of money. But BoA uses a third system that not obvious and visible to us. I understand their point of view but their business practices as misleading and shady. Same with the sorting charges by the amount…

Anyways, I got my money back, learnt my lesson and I moved my money to a small local bank. They don’t have the fancy online stuff and such, but every day I go in the CEO is there to say hi and I feel like somebody cares and they value my business…

Thank you so much for this blog. I also had five overdraft fees assessed that were ultimately due to my error (I marked a check as cleared that had not cleared throwing my balance off by $1000). Had the charges been posted lowest to highest, only the check would have overdrafted, but because of the highest to lowest policy, the large check posted first. I called the 800 number and they “reviewed” the account and said they could not refund the fees.

I called the Chairman’s office and the advocate kindly listened to my story (where I did admit fault, but registered my disagreement with the policy). He educated me about why they order things they way they do (of course they think it’s to help me, I know it’s to help them), and refunded all $175 in overdraft fees. You can bet I’ll pay more attention to what I’m doing from now on!

Since my last post March 28th, I have received back all overdraft fees. Nancy was the one who helped and should be the example to all other BofA employees of how to treat a customer with respect – even when they screw up.

My fees refunded totaled $630. Keep in mind, this was my own mistake and not something I expect the bank to cover on a regular basis going forward. It was great to see someone work for me at the bank even after others refused to help.

WOW….So I had about $175 in OD fees. I called cust service, and the agent just kept saying they cannot unless its their error. Asked to talk to Manager, manager was nice enough to give me $70 only. Offered me the alerts.

Then I did a google, and found this post. Read the great reviews from all who tried the 704 number posted by David.

At first, I was hesitant, it was around $105 in fees. But still, I called, and talked to this amazing and friendly lady at the chairman office. I explained my situation, and informed that I just found out about alerts, complemented the Manager who assisted me with the $70 credit and asked if she can help me with this, as all I am trying to do is LIVE in this bad economy.

She was great to just go ahead and credit my account for the $105 in fees. She did inform me that this was a one-time chairman office re-credit.

She also wanted to know how and where I got this number from. I asked if it is necessary for me to disclose the source. She informed me that they just want to track how this number is distributed. I just told her that I have worked in call center before and I know how chain of command works. Did not disclose that I found info from here.

But, THANKSSSSSSSSSSSSSSSSSSSSSS a Lot David. You helped me big with this. I needed the help and you got it to me. Thanks a lot.
